Article 4 - Prices
All prices indicated on the omadesign.fr sales site are expressed in € (euros), are freely set by the company Fanny Mothes and include all taxes.
The total price must be paid in full at the time the order is finalized, i.e. the price of the item(s) as well as the delivery costs.
Delivery costs are charged in addition. They are clearly indicated when the order is placed and include shipping and packaging costs.
All prices listed on the omadesign.fr website are non-negotiable by the buyer.
Article 5 - Withdrawal period
Pursuant to Article L.121-20 of the French Consumer Code, the buyer has a period of 14 working days to return, at his or her own expense and risk, the item or items that are not suitable for exchange or reimbursement. This period runs from the day of receipt of the order.
This right of withdrawal is exercised without penalty, however the shipping costs will be charged to the buyer and the conditions of shipment and return must be identical.
The articles must be returned in new condition and in their original packaging. Otherwise, the items will not be returned, refunded or exchanged.
Once the buyer has exercised his/her right of withdrawal within the time limit, the company Fanny Mothes undertakes to reimburse him/her within 30 days following the date on which this right was exercised (article L.121-20-1 of the French Consumer Code), the totality of the sums paid, with the exception of the shipping and return costs.
Article 6 - Payment
The buyer must pay for his order in full at the time of acceptance using the payment method proposed on the omadesign.fr website.
The method of payment accepted by the company Fanny Mothes and its online sales site omadesign.fr is the credit card.
Article 7 - Delivery
The omadesign.fr website undertakes to ship orders within 3 to 4 weeks, including manufacturing time. Unless otherwise stipulated, delivery is made to the address indicated by the buyer when placing the order. The products will be sent by GLS or BMV. Oma Design declines any responsibility in case of too long delivery time due to the carriers, as well as in case of loss of the ordered products or strike. The risks of the transport are supported by the purchaser, who will have to formulate a motivated protest with the services of the carriers within three working days as from the delivery. Moreover, it is specified that the property of the ordered products will be transferred to the purchaser only with the total payment of the invoiced price, and it included the expenses of delivery. This being the case, in spite of all the care brought by Oma Design in the preparation of the parcels, it is possible that an object is missing. Also, after transporting the parcel, one of the objects may be damaged. That's why, at the reception of his order, the buyer will check the conformity of the received objects. Any anomaly concerning the delivery (missing object, erroneous model/color combination, damaged parcel) will have to be imperatively notified, the same day of the reception or at the latest the first working day following the reception, to Oma Design - 7 cours Comte de Cabarrus - 64100 Bayonne - France or by e-mail addressed to omadesignfr@gmail.com. Any claim formulated after this delay and Oma Design will be released from any responsibility. Oma Design reserves the possibility to ask the buyer to return the defective product. The return costs will be charged to the buyer unless the return is due to an error on the part of Oma Design. If the above-mentioned conditions are fulfilled, Oma Design will then proceed either to the exchange or to the refund of the defective product(s), or to the reshipment of the missing product (subject to the validity of the buyer's request).

Article 8 - Protection of personal data
The personal information collected is essential for the treatment and the routing of the orders as well as the establishment of the invoices.
In accordance with the law "Informatique et Libertés", the processing of personal information is the subject of a declaration to the Commission Nationale de l'Informatique et des Libertés (C.N.I.L) under the n° 870809.
The personal data are in no case transmitted to third parties.
Article 9 - Applicable law
The present general conditions of sale are subjected to the French law.
In the event of a dispute, the buyer undertakes to contact the company Fanny Mothes in priority through the website omadesign.fr in order to find an amicable solution.
Article 10 - Modification of the general sales conditions
Oma Design reserves the right to modify at any time the present general conditions of sale.
